Terms of Service

These Terms of Service ("Terms") govern your access to and use of picpocket(the "Service"). By creating an account, signing in, scanning an event QR code, or uploading photos, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

picpocket lets event organizers create events, share QR codes, and collect photos from guests through a web browser. Guests may participate with or without an account, subject to the options presented in the product. Organizers decide which photos are shared with all participants.

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and have authority to agree to these Terms.

You are responsible for activity under your account and for keeping your sign-in credentials secure. If you join an event without signing in, you acknowledge that access may be limited to your current browser session and that photos may not remain available after you leave, as described in the product flow.

If you sign in for ongoing access, you may be able to view events you attended and photos shared with participants, subject to organizer settings.

The Service requests camera access only when you choose to capture photos. You represent that you have the right to upload any content you submit and that your uploads comply with applicable law.

You must obtain consent from people identifiable in photos you upload when required by law. Organizers are responsible for informing guests that photos may be collected and analyzed at their event.

If you create or manage an event, you agree that you:

• have authority to collect photos at the event;
• will provide appropriate notice to guests about photo collection;
• will use sharing controls responsibly;
• will not use the Service for unlawful, harmful, or harassing purposes.

You may not:

• upload illegal, infringing, exploitative, or non-consensual intimate imagery;
• attempt to access other users' data without authorization;
• interfere with or disrupt the Service;
• reverse engineer or misuse the Service except as permitted by law;
• use the Service in violation of any applicable law or regulation.

You retain ownership of photos and content you upload. You grant picpocket a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, and distribute your content solely as needed to operate and improve the Service (including generating thumbnails and facial feature indexes for photo discovery).

The Service, including its design, software, and branding, is owned by us or our licensors and is protected by intellectual property laws.

picpocket offers an Essentials plan (free for your first event, then paid) and paid Plus and Pro plans. Each paid plan is a one-time, non-recurring purchase applied to a single event. All payments are processed by Stripe; we do not store your card details.

Each plan has limits on photos, RSVPs, live-stream duration and viewers, and how long we retain event photos (Essentials: 30 days, Plus: 90 days, Pro: 1 year). We may warn you before removing photos and will delete them from storage after the retention window unless you upgrade. Fees are non-refundable except where required by law.

The Service integrates third-party providers (such as cloud infrastructure, authentication, email, storage, and image analysis). Your use of those features may also be subject to third-party terms and privacy policies.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PHOTOS WILL BE PERMANENTLY STORED OR RECOVERABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICPOCKET AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You will defend, indemnify, and hold harmless picpocket and its operators from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

We may suspend or terminate access to the Service at any time for violation of these Terms or to protect the Service or other users. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

These Terms are governed by the laws applicable where the Service operator is established, without regard to conflict-of-law rules. You agree to attempt to resolve disputes informally by contacting privacy@picpocket.app before initiating formal proceedings, where permitted by law.

We may modify these Terms from time to time. Continued use after changes become effective constitutes acceptance of the revised Terms, except where additional consent is required by law.
